Welcome to Pawty Yoga. By accessing our website (pawtyyoga.com), purchasing tickets, attending our events, or using our services, you agree to the following terms and conditions. Please read them carefully.

1. About Pawty Yoga

Pawty Yoga is a puppy yoga experience operated in Houston, Texas. We offer group yoga sessions, private events, birthday pawties, and corporate team-building experiences featuring live puppies in a supervised, indoor environment.

2. Booking and Payment

• All bookings are subject to availability.
• Payment is required at the time of booking unless otherwise stated.
• Prices are listed on our website and are subject to change without notice. The price at the time of your purchase will be honored.
• Private event pricing is provided on a per-request basis.
• Pawty Yoga reserves the right to limit the number of tickets purchased per person or per transaction.

3. Cancellation and Refund Policy

• Cancellations made 7 days or more before the event will receive a full refund.
• Cancellations made less than 7 days before the event are non-refundable. However, you may transfer your ticket to another person by contacting us at [email protected] or (281) 408-4647.
• If Pawty Yoga cancels an event for any reason, you will receive a full refund or credit toward a future session. Pawty Yoga is not liable for any additional costs incurred by attendees (e.g., travel, accommodations, childcare).
• No-shows are non-refundable but may transfer their booking to a future session at our discretion.
• Late arrivals will not receive a partial refund or extended session time. Sessions begin and end at the scheduled time regardless of when you arrive.
• Refunds are processed to the original payment method within 7-10 business days.

4. Assumption of Risk and Liability Waiver

By purchasing a ticket or attending a Pawty Yoga event, you acknowledge and agree that:

• Interaction with live animals carries inherent risks, including but not limited to scratches, bites, nips, allergic reactions, exposure to pet dander, saliva, or waste, and the risk of tripping or falling.
• You voluntarily assume all risks associated with participating in yoga activities and interacting with puppies, whether or not described above.
• Pawty Yoga, its owners, officers, employees, contractors, partners, venue hosts, and puppy providers are not liable for any injuries, illness, property damage, or losses arising from your participation in our events.
• You waive any and all claims against Pawty Yoga and its affiliates related to personal injury, property damage, or any other loss arising from your attendance.
• Participants under 18 must have a parent or legal guardian present at all times. The accompanying adult assumes full responsibility and liability for the minor's participation and conduct.
• This waiver is binding upon you, your heirs, executors, and assigns.

5. Indemnification

You agree to indemnify, defend, and hold harmless Pawty Yoga, its owners, employees, contractors, partners, and venue hosts from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

• Your participation in any Pawty Yoga event
• Your violation of these Terms and Conditions
• Your negligent or wrongful conduct at an event
• Any injury or damage caused by you or any minor in your care to other attendees, staff, animals, or property

6. Health and Safety

• All puppies are health-checked and age-appropriate for safe socialization.
• We clean and sanitize all surfaces between sessions.
• If you have known severe allergies to dogs, you attend at your own risk. We recommend consulting your physician before attending.
• Please do not attend if you are feeling unwell or have symptoms of a contagious illness.
• Pawty Yoga does not provide medical services. In the event of an injury or medical issue, you are responsible for seeking your own medical attention and covering any associated costs.

7. Conduct at Events

• Treat all puppies gently and follow the instructions of our handlers at all times.
• Do not pick up, chase, or rough-handle the puppies.
• No outside food, drinks (other than water), or animals are permitted at events unless pre-approved.
• Pawty Yoga reserves the right to remove any participant who behaves in a manner that is unsafe, disruptive, or harmful to the animals, staff, or other guests. No refund will be issued in such cases.
• You are responsible for any damage you cause to the venue, equipment, or property during the event. You agree to pay for any such damages in full.

8. Personal Belongings

Pawty Yoga is not responsible for any lost, stolen, or damaged personal belongings brought to our events. Please keep valuables secured at all times.

9. Photography and Media

By attending a Pawty Yoga event, you grant Pawty Yoga a perpetual, royalty-free, worldwide license to use photographs, videos, and recordings that include your likeness for marketing, advertising, social media, and promotional purposes. If you do not wish to be photographed, you must notify our staff in writing at the beginning of the event.

10. SMS/Text Message Terms

By texting our business number or opting in to receive text messages from Pawty Yoga, you agree to the following:

• You consent to receive SMS messages related to event updates, booking confirmations, reminders, and customer support.
• Message and data rates may apply. Message frequency varies.
• You can opt out at any time by replying STOP.
• Reply HELP for assistance.
• We will not share your phone number with third parties for their marketing purposes.

11. Intellectual Property

All content on pawtyyoga.com, including text, images, logos, and design, is the property of Pawty Yoga and may not be reproduced, distributed, or used without our written permission. Unauthorized use may result in legal action.

12. Third-Party Services

Our website and services may integrate with third-party platforms (e.g., payment processors, SMS services, chat tools). Your use of those services is governed by their respective terms and privacy policies. Pawty Yoga is not responsible for the actions, content, or policies of any third-party service.

13. Force Majeure

Pawty Yoga shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government orders, venue unavailability, power outages, or animal welfare concerns. In such cases, we will offer a full refund or credit toward a future event at our discretion. Pawty Yoga is not liable for any additional costs or damages resulting from such cancellations.

14. Limitation of Liability

To the fullest extent permitted by law, Pawty Yoga's total liability for any claim arising from your use of our services or attendance at our events shall not exceed the amount you paid for the specific session or event in question. In no event shall Pawty Yoga be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of enjoyment, emotional distress, travel costs, or lost wages.

15. Dispute Resolution

Any dispute, claim, or controversy arising from or relating to these Terms or your attendance at a Pawty Yoga event shall first be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be settled by binding arbitration administered in Harris County, Texas, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs and attorney's fees unless the arbitrator determines otherwise. You agree to waive any right to a jury trial or to participate in a class action lawsuit against Pawty Yoga.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Changes to These Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services constitutes acceptance of the updated terms.

18. Governing Law

These terms are governed by the laws of the State of Texas. Any disputes not subject to arbitration shall be resolved exclusively in the courts of Harris County, Texas.
